These Terms of Service ("Terms") govern your access to and use of Aether Track (the "Service"), provided by Noelle Giebe ("we", "us", "our"). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
Aether Track is a real-time global radar that aggregates publicly available data — aircraft (ADS-B), ships (AIS), satellites, weather, rocket launches, wildfires, air quality and drone airspace — and presents it on an interactive map. A free tier and a paid "Pro" subscription tier are offered.
2. Eligibility & Accounts
You must be at least 16 years old (or the age of digital consent in your jurisdiction) to use the Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate information and keep it updated.
3. Acceptable Use
You agree not to:
- Use the Service for any unlawful, fraudulent, or harmful purpose;
- Send spam, malware, or otherwise interfere with the security or integrity of the Service;
- Probe, scan, scrape, or test the vulnerability of any system or network;
- Infringe the intellectual property, privacy, or other rights of any person;
- Use the Service to make safety-of-life decisions — Aether Track is not a navigational aid and must not be relied upon for flight, maritime, emergency, or air-traffic-control purposes.
4. Intellectual Property
The Service, including its software, design, branding, and original content, is owned by us and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms and your selected plan. You may not reverse engineer, resell, redistribute, or circumvent technical limits of the Service. Source data (e.g. ADS-B, AIS, NOAA, Celestrak) belongs to its respective providers.
5. Subscriptions, Payments & Refunds
Pro is offered as a recurring monthly subscription that renews automatically until canceled. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation, and renewal mechanics are governed by the Paddle Buyer Terms. Refund requests are handled per our Refund Policy.
6. No Warranty
The Service is provided "as is" and "as available" without warranties of any kind. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free, or that data shown will be accurate or complete.
7. Limitation of Liability
To the maximum extent permitted by law, our aggregate liability arising out of or relating to the Service is limited to the greater of (a) the fees you paid us in the 12 months preceding the claim, or (b) USD $50. We are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or business interruption. Nothing in these Terms excludes liability that cannot lawfully be excluded (e.g. fraud, death, or personal injury caused by negligence).
8. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, or expenses arising out of your use of the Service, your content, your violation of these Terms, or your violation of any law or third-party right.
9. Suspension & Termination
We may suspend or terminate your access to the Service at any time for: material breach of these Terms, non-payment, suspected fraud or security risk, or repeated/serious policy violations. You may stop using the Service at any time and cancel your subscription via the customer portal. On termination, your right to use the Service ends; sections that by their nature should survive (IP, disclaimers, liability, indemnification, governing law) will survive.
10. Changes
We may update these Terms from time to time. Material changes will be communicated via the Service or by email. Continued use after changes take effect constitutes acceptance.
11. Governing Law
These Terms are governed by the laws of the jurisdiction in which Noelle Giebe resides, without regard to conflict-of-laws principles. Disputes will be resolved by the competent courts of that jurisdiction, subject to any mandatory consumer protections that apply to you.
